The Cabinet of Ministers of Ukraine passed in the Verkhovna Rada a draft law "On the Land» № 9001-1, which is registered in the parliament on Tuesday. According to the explanatory memorandum to the bill, the document is aimed at the completion of the market conditions for the involvement of agricultural land in the economic cycle, the organization of a transparent land market with the introduction of competition in their sale, to ensure completeness of income taxes and charges, particularly from land sales and lease rights on them, as well as state tax on transactions in the land market.
In addition, the document provides prevention of corruption by creating a clear and transparent procedures for preparing for sale and the sale of land lease rights for them at auction, sets uniform rules and restrictions on sales of land on the market.
Under the bill, agricultural land have the right to buy Ukraine's citizens, farms, the state represented by the central authority on land or territorial communities.
The document assumes that the foreign person will have no ownership of agricultural land. At the same entities that own land, but more than 10% of their charter capital owned by foreign entities are required to carry out the procedure of land alienation. Otherwise, it will be withdrawn in court and transferred to state ownership.
The bill also prohibits the right to make land in registered capital.
In addition, the document sets out the maximum area of land that can be owned by one person. In particular, such a rule in Polesie is 1.5 ha, forest - 1.75 hectares, Stepney - 2.1 ha, the Carpathian mountain area - 900 hectares, the Crimean mountain area - 1.1 hectares . In other regions the size of the land in the hands of one should not exceed 2.1 hectares. At the same time, the total area of land may exceed the maximum limit in case of inheritance of land.
The explanatory note to the document notes that the revenues to the state budget to lease at 1.4 million ha of unclaimed shares, about 2.8 million hectares of reserve land (arable land) and 1.8 million hectares of agricultural lands escheated heritage with an average regulatory monetary Assessment 1 ha of arable land in 11.949 ths could make 2.1 billion USD a year (at an annual rental rate of 3% of the normative assessment of the monetary area).
As reported, Ukraine is currently a ban on the sale of agricultural land to be withdrawn, subject to the laws of the state land cadastre and land market.
The law № 8077 "On State Land Cadastre" was adopted by Parliament July 7, 2011 and shall come into force on January 1, 2012 except for certain provisions, while the adoption of the draft law on land market Goszemagentstvo predicted for this fall.
