The Cabinet proposes Verkhovna Rada of legislation to reduce the time allotment of land for urban needs in 1.5-3 times, limiting the duration of its phases of 10.7 days. This is stated in the bill "On Amendments to Certain Legislative Acts of Ukraine regarding reducing the period of land allocation for urban needs," registered in the parliament on June 15.
Under the bill, the term decision-making and review applications for land privatization, as well as the period of consideration of the application and the decision to develop a project on land allotment of land is proposed to reduce three times - up to 10 days.
"If this had been done in reality - fine, but I think that this is unlikely. 10 days is too short term. Technically, such a decision requires a lot of state officials, "- said Maxim Building.ua Kopeychikov, a partner at law firm" Ilyashev and Partners "
As stated in the bill, the document also provides for a three-fold reduction in the term (a week) agreeing on a draft land management, as well as reduction in two weeks to ten days a decision on the approval of the project land for allotment of land and granting it ownership of local authorities.
The Verkhovna Rada also proposed to reduce the time to develop a project on land allotment of land from the month prior to 10 days, as well as to establish that the development time of these documents on land management should not exceed a month from the date of the contract.
"If it is a design solution - this is likely, but if a decision on privatization - no. An important role in this process is the fact at what point and what documents will be ready to implement the application. The viability of this rule can be provided, if at the time the application is ready to be city planning, decisions of bodies of land, sanitary solutions. But I do not believe that this will work - any ideal rule of law will not work without proper execution "- summed up the lawyer.
