Opening sales of agricultural land to foreign nationals after the lifting of the moratorium is possible only if appropriate amendments to the Constitution of Ukraine, said a partner of the legal group AstapovLawyers Tatyana Kuzmenko.
"A serious obstacle for foreigners to ownership of land can become Article 14 of the Constitution, which guarantees the realization of this right only to citizens, legal persons and state. Therefore, speaking about the availability of the land market to foreigners, it is understood that the "open" the market may be either 2 / 3 vote of the deputies, making changes to the Constitution or the Constitutional Court "correctly" interpreting the meaning of this article "- she said.
Previously deputy head of presidential administration Irina Akimova said that the authorities intend to dedicate 2011 preparation of land reform to start from 2012, the land market. "From 1 January 2012 the market should be open not only to citizens of Ukraine but also for foreign nationals wishing to work in this area," - she said.
In Ukraine currently has a ban on the sale of agricultural land prior to the adoption of laws on state land cadastre and land market. In addition, the Verkhovna Rada of Ukraine December 22, 2009 passed a law to extend until January 1, 2012 moratorium on the sale of farmland and 19 January 2010 has overcome a presidential veto on the bill.
Parliament of 20 March 2007 adopted a law on state land cadastre, but later the president vetoed this document. The draft law on land market was adopted only in the first reading.
